In consideration for Cairo Outdoors and their affiliates, owners, members, directors, officers, agents, employees, independent contractors and volunteers allowing me to participate in Cairo Outdoors activities, including, but not limited to, roped climbing walls, bouldering walls, bicycle rentals and bicycle riding, kayaking and kayak rentals and any other training or fitness apparatus operated by Cairo Outdoors, gear demonstrations, clinics, training, yoga or other fitness classes, outdoor climbing, camps or classes, the renting or borrowing of equipment from Cairo Outdoors, or any other activities offered by or involving Cairo Outdoors, the undersigned hereby understands, acknowledges and agrees as follows:

1. I am capable of understanding the terms of this agreement and the risk associated with Cairo Outdoors activities.

2. I recognize and understand that there are risk, hazards and dangers in Cairo Outdoors activities, whether inherent or not, and participation could result in injuries of all kinds, including serious injury or death. The risk involved in Cairo Outdoors activities include, but not limited to: hazards traveling to location of the activity, falling, collision with objects, people or structures, falling onto uneven, worn or hard landing surface, being struck by other participants or objects, loose handholds or footholds, loose rock, equipment failure even if equipment is properly used, the actions or negligence of other participants or instructors, harm due to exposure to the elements, the aggravation of pre-existing conditions and other risk in Cairo Outdoor activities. I understand that my participation in Cairo Outdoors activities is voluntary and that i have the right to terminate my participation at any time. I acknowledge that i am capable of participating in Cairo Outdoors activities and do not suffer from any health problems, mentally or physically, that would inhibit my participation or that would be worsened by participating in Cairo Outdoors activities.

3. I understand that Cairo Outdoors is a climbing gym. The climbing wall range from 12-18 feet in height.

   To lower the risk of injury it is important that you:

   • Are aware of your surroundings and others at all times

   • Keep pockets empty

   • Do not wear rings, watches or necklaces

   • Do not climb or raise your head above the wall

   • Do not climb over other people or items misplaced on the floor

   • Be aware of other participants and the direction they are going

4. ASSUMPTION OF RISK: Understanding these risk and dangers, I nevertheless EXPRESSLY ASSUME ALL RISK ASSOCIATED WITH ANY CAIRO OUTDOORS ACTIVITIES, inherent or otherwise, and whether or not described above. I further agree to observe and comply with all rules and regulations prescribed by Cairo Outdoors.

5. RELEASE OF LIABILITY: Additionally, I for myself, heirs, assigns, representatives and next of kin, unconditionally release and discharge Cairo Outdoors and the affiliates, owners, members, directors, officers, agents, employees, independent contractors and volunteers from any damage, claims, liability, or cause of action, whether known or unknown, arising out of my participation in Cairo Outdoors Activities, including claims of ordinary negligence. Furthermore, I hereby agree to indemnify Cairo Outdoors from any claim, liability, or cause of action by third parties arising out of my participation in Cairo Outdoors activities.

6. I understand that i am responsible for assessing the quality of my own equipment I bring to the Cairo Outdoors facility or activities and that it is in good condition and working order. I understand that Cairo Outdoors is not liable for any lost or stolen equipment or personal items i bring to Cairo Outdoors or activities.

7. I understand that participation in any Cairo Outdoors activities under the influence of drugs, alcohol or other substances is not allowed at Cairo Outdoors or activities.

8. I understand that participation in Cairo Outdoors activities is physically and mentally challenging and I declare that I have no physical, mental or medical issues that would put myself or others in harm by participating in Cairo Outdoors activities.

9. I understand that in order to participate in Cairo Outdoors activities I must complete all the following: sign this agreement, complete whatever instructional program Cairo Outdoors requires and read and abide by the rules and regulations prescribed by Cairo Outdoors

10. In the event of an accident, I authorize Cairo Outdoors to stabilize, obtain medical care for, or transport me to a medical facility if, in the opinion of Cairo Outdoors, medical care is needed and I am unable to make such decision myself. I agree to pay the cost associated with such actions on the part of Cairo Outdoors, and to indemnify and hold Cairo Outdoors harmless from any consequences resulting from such care.

11. Cairo Outdoors is hereby authorized to take photos and video of me in connection to my participation in Cairo Outdoors activities and has my permission to use my first name and likeness, without compensation, for marketing and other promotional purposes.

12. If it becomes necessary for Cairo Outdoors to enforce this agreement Cairo Outdoors shall receive attorney fee's, expenses and cost for any action required to enforce or defend this agreement.

13. I understand that this agreement shall continue in effect and remain in force in perpetuity from the date it is executed, and covers my participation in all Cairo Outdoors activities, regardless of when or where the activity takes place.

I HAVE CAREFULLY READ, UNDERSTAND AND VOLUNTARILY SUBMIT THIS ACKNOWLEDGMENT AND ASSUMPTION OF RISK, RELEASE OF LIABILITY AND INDEMNITY AGREEMENT.

PARENTS OR LEGAL GUARDIANS ADDITIONAL INDEMNIFICATION

In consideration of the following minor being permitted by Cairo Outdoors to participate in its activities and to use its equipment and facilities, I further agree to indemnify and hold harmless Cairo Outdoors from any and all claims which are brought by, or on behalf of said minor, and which are in any way connected with such use or participation by said minor.
